1Acceptance of Terms
By accessing or using USCompaniesList.com (the "Site") or purchasing any product from us, you ("Buyer," "Customer," or "you") agree to be legally bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use this Site or purchase our products.
These Terms constitute the entire agreement between you and USCompaniesList.com regarding the purchase and use of our database products. They supersede any prior agreements or representations, written or oral.
2The Product
USCompaniesList.com offers a US business database bundle ("the Database") comprising three independently sourced databases:
- US Company Database — approximately 66 million records compiled from B2B portals, government registration records, and public business filings
- US Business Database — approximately 31 million records sourced from Yellow Pages directories and business registration records
- US Email Database — approximately 37 million total records, of which approximately 28 million include an email address, compiled from publicly available business records
All three databases are delivered in CSV (comma-separated values) format, organized by US state. Files may be split into multiple parts for states with large record counts, with a maximum of 1 million records per file.
All data in our databases is compiled from publicly available sources including government business registration records, public directories, Yellow Pages, and publicly accessible business portals. We do not collect, use, or sell any consumer personal data or private individual information.
3Payment & Delivery
All purchases are made via PayPal, our sole payment processor. By completing a purchase, you agree to PayPal's Terms of Service. We do not collect, store, or process credit card or bank account details directly — all financial transactions are handled exclusively by PayPal.
Upon successful completion of payment, your download link is made available immediately and automatically — there is no manual review, waiting period, or additional steps required. You will receive a download link via the email address associated with your PayPal account.
If you do not receive your download link within a reasonable time after payment, please contact us through our Contact Us page with your PayPal transaction ID or receipt and we will assist you promptly.
The purchase price is $499 USD as a single one-time payment. There are no recurring charges, subscriptions, renewal fees, or hidden costs of any kind.
4No Refund Policy
Because our product is a digital download that is made available to you immediately upon payment, all sales are final and non-refundable. Once the download link is delivered and the files have been made available, the transaction is complete.
This no-refund policy exists because:
- Digital goods cannot be "returned" once downloaded or accessed
- We provide a free live sample on our website for you to review actual data quality, fields, and structure before purchasing
- The product description, field list, and record counts are clearly published prior to purchase
We strongly encourage all prospective buyers to review our sample data and FAQ section before completing a purchase. By submitting payment, you acknowledge that you have had the opportunity to review the sample data and that you understand the nature of digital goods.
If you experience a technical issue receiving your download, please contact us and we will resolve the delivery issue — this is not grounds for a refund but we will ensure you receive what you purchased.
5Permitted Use
Upon purchase, you are granted a non-exclusive, non-transferable license to use the Database for the following lawful business purposes:
- B2B sales prospecting and lead generation
- Email marketing campaigns targeting businesses (subject to CAN-SPAM compliance — see Section 7)
- Telemarketing and cold calling campaigns
- Market research and competitive analysis
- Building internal business directories or CRM databases
- Recruiting and talent acquisition outreach
- Direct mail campaigns
- Data enrichment for existing databases
You may use the data across multiple campaigns and projects within your organization. The license is for your use — individual or single business entity — only.
6Prohibited Use
You agree that you will NOT use the Database for any of the following:
- Reselling, redistributing, sublicensing, or sharing the data with third parties outside your organization without our express written consent
- Sending unsolicited emails in violation of the CAN-SPAM Act or any other applicable anti-spam law
- Harassment, stalking, or targeting individuals for personal harm
- Any unlawful purpose, including but not limited to fraud, identity theft, or phishing
- Building a competing database product for public sale or distribution
- Violating any applicable federal, state, or local laws or regulations
- Any use that could damage the reputation of USCompaniesList.com
Violation of these prohibited use terms may result in immediate termination of your license and potential legal action. You bear full and sole responsibility for how you use the data.
7CAN-SPAM Act Compliance
If you use the Database to send commercial email, you are solely responsible for ensuring full compliance with the CAN-SPAM Act of 2003 (15 U.S.C. § 7701 et seq.) and any other applicable email marketing laws, including but not limited to GDPR (if marketing to EU residents) and CASL (if marketing to Canadian residents).
Your CAN-SPAM obligations when using our data include:
- Using an accurate, non-deceptive "From" name and email address
- Using an honest, non-misleading subject line
- Clearly identifying the email as an advertisement where required
- Including your valid physical postal address in every email
- Providing a clear and working opt-out/unsubscribe mechanism in every email
- Honoring opt-out requests within 10 business days
- Maintaining a suppression list of unsubscribed addresses
- Not sending emails to addresses that have previously opted out
By purchasing our Database and using it for email marketing, you agree to use it responsibly and in full compliance with all applicable laws.
8Data Accuracy & No Accuracy Guarantee
The business data in our databases is compiled from publicly available sources. While we strive to provide the most accurate and complete data possible, we cannot and do not guarantee 100% accuracy of any record in the Database.
The US business landscape changes constantly — companies open, close, relocate, change ownership, change phone numbers, and update contact personnel on a daily basis. No database provider can guarantee complete accuracy at the time of your use.
We recommend:
- Using email verification tools before sending large campaigns
- Reviewing our free sample data before purchase to understand data structure and quality
- Understanding that bounce rates on compiled B2B databases are normal and expected industry-wide
The buyer accepts the data "as-is" with respect to accuracy. Data inaccuracy is not grounds for a refund.
9Disclaimer of Warranties
THE DATABASE AND ALL RELATED SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, USCOMPANIESLIST.COM EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Any warranty that the data will be error-free, accurate, complete, or current
- Any warranty regarding the results that may be obtained from use of the data
- Any warranty that the data will meet your specific business requirements
We do not warrant that the data is free from inaccuracies, omissions, or outdated information. You use the data entirely at your own risk.
10Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, USCOMPANIESLIST.COM, ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE DATABASE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This includes, without limitation:
- Lost profits, lost revenue, or lost business opportunities
- Costs of substitute products or services
- Damages arising from inaccurate, incomplete, or outdated data
- Damages arising from your use or misuse of the data in email campaigns, telemarketing, or any other outreach
- Third-party claims against you arising from your use of the data
- Fines or penalties imposed on you by regulators for CAN-SPAM or other violations
- Any technical issues related to downloading or accessing the data
In no event shall our aggregate liability to you exceed the amount you paid for the Database ($499 USD). You acknowledge that this limitation of liability is a fundamental element of the basis of the bargain between you and USCompaniesList.com.
11Indemnification
You agree to indemnify, defend, and hold harmless USCompaniesList.com, its owners, officers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use or misuse of the Database
- Your violation of these Terms and Conditions
- Your violation of any applicable law, including CAN-SPAM, GDPR, or CASL
- Any email campaign, telemarketing campaign, or other outreach you conduct using the data
- Any third-party claim arising from your use of the data
12Intellectual Property
The compilation, selection, arrangement, and presentation of the Database as a product constitutes our intellectual property. While the underlying individual business data points may be from public sources, the assembled database product is proprietary.
You may not resell, redistribute, publish, or otherwise make the Database available to third parties without our express written consent. Your license is for internal business use within your own organization only.
All website content, design, logos, and branding of USCompaniesList.com are owned by or licensed to us and may not be reproduced without permission.
13Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States. Any dispute arising under these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in a court of competent jurisdiction.
You agree that any cause of action arising out of or related to these Terms must be filed within one (1) year after the cause of action arises, or be permanently barred.
14Changes to These Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued use of the Site or the Database following any changes constitutes your acceptance of the updated Terms.
We recommend reviewing these Terms periodically, especially before making additional purchases.
